TRIALS

Represented Defendants against a lawsuit filed against them for conversion, breach of oral contracts, breach of fiduciary duty, breach of duties as bailee, and intentional misrepresentation. Plaintiff was seeking more than $1.2 million in damages for personal and real property she claimed was converted by Defendants.
The Heritage Law Group successfully defended the suit all the way to trial and proved that Plain-tiff ’s allegations were meritless. Verdict at trial was entered in favor of Defendants on all causes of action. Plaintiff took nothing from her complaint.

Represented Plaintiff against a real estate broker who had borrowed funds from his client and sought to have the note and deed of trust that secured the debt invali-dated under a theory that the interest charged was usurious, even though it was the real estate broker who drafted the Note. The Heritage Law Group successfully won the case and verdict was entered in favor of Plaintiff. Plaintiff was awarded all outstanding amounts owed, along with interest, attorney’s fees, and all costs.

Represented Defendants against claim of fraud, fraudulent misrepresentation where Plaintiff was seeking damages more than $15 million dollars. Defendant strongly asserted that the case was meritless and that he had done no wrongdoing. Success-fully defended case and after long cause jury trial, the jury entered a verdict in fa-vor of Defendant and the Plaintiff was awarded nothing.

ADA ACCESS DEFENSE

Restaurant owner faced federal lawsuit for failing to provide equal access to dis-abled wheel chair bound adult. The federal lawsuit sought damages in excess of $100,000 plus attorney’s fees and costs. The case was settled for $13,000.

Restaurant owner faced federal lawsuit for failing to accommodate service an-imal. The federal lawsuit sought damages in excess of $50,000 plus attorney’s fees and costs. The case was settled for $8,000.

CITY MUNICIPAL HEARINGS

Successfully defended against real property violation notice for real property lo-cated in City of Santa Clara. The City of Santa Clara claimed that the real prop-erty contained an illegal bedroom. The Heritage Law Group successfully negoti-ated removal of the violation notice and to have the area lawfully permitted.

Successfully appealed denial of tree removal permit for the City of Los Gatos. Tree had been the subject of approximately ten (10) year neighbor dispute and after The Heritage Law Group successfully settled the litigation in this matter to include removal of the tree the City of Los Gatos originally denied the tree re-moval permit because it was a protected tree. The Heritage Law Group, a P.C. filed an appeal and proved that the tree was a nuisance and was a threat of im-minent harm. The tree permit was granted and the tree was removed.

Successfully defended red tagged of real property located by the City of Santa Clara. Assisted clients in getting red tag removed and property rehabbed for sale.

AGENCY CASES

Successfully defended against real estate license revocation. The agent faced re-vocation of her license because there was a crime of moral turpitude for theft she committed. The Heritage Law Group successfully negotiated a restricted license with the right to remove the restriction with Bureau of Real Estate (for-merly Department of Real Estate) and agent could continue working with her license.

Successfully defended against real estate license denial when applying for his real estate license. The license applicant was denied his license for having mul-tiple driving under the influence charges and reckless driving charges for ma-jor speeding infractions when he was younger. The Heritage Law Group, a P.C. appealed the denial and successfully demonstrated that the crimes were com-mitted in the agent’s youth and at trial the license as approved with restrictions with the right to remove the restriction at a later date.

Effectively defended real estate broker who faced revocation of his broker’s license for improper supervision of agent charged with defrauding clients. Agent did in fact defraud clients without real estate broker’s knowledge or consent.

The Heritage Law Group, a P.C. successfully negotiated a restricted broker’s li-cense with the right to have restriction removed at future date.

Meritoriously defended a real estate broker who faced revocation of this broker’s license due to trust account imbalances and irregularities. The Heritage Law Group, a P.C. successfully obtained a restricted broker’s license.

Contractor state license defense against disgruntled client. Contractor claimed no wrong doing but was facing revocation of his license. Successfully proved that disgruntled client case was meritless and claimed was denied.

PROBATE/ TRUST LITIGATION

Successfully petitioned court for removal of trustee who was committing self-dealing and using trust funds for her own personal expenses. Trustee was re-moved and third party trustee was appointed.

Successfully settled a will contest where the Plaintiff was facing charges of ob-taining the will by fraud and undue influence. The Heritage Law Group, a P.C. was able to obtain a settlement whereby the Plaintiff was able to keep the real property in Sunnyvale, valued in excess of $1.5 million, that had been left to her in the will.

REAL ESTATE CASES

Successfully obtained ownership interest of real property owned by multiples persons but only one person on title and loan. The person on title claimed that he was the sole owner and denied any ownership interest to the other parties. The Heritage Law Group, filed suit and at mediation settled the matter with each owner getting their fair share. Property was sold and proceeds were split according to the ownership interest negotiated at settlement.

TECHNOLOGY STARTUP

Defended against a claim of improper use of trade secret information. Client had left his old employer and opened his own business. His old clients found him and began using his services at his new company. Past employer claimed that client had wrongfully solicited customers by misappropriated trade secret information. The Heritage Law Group successfully defended the claim before litigation commenced and proved that the client had committed no wrongdoing and had not solicited any of his old customers. Past employer dropped the claim before filing suit. Case resolved quickly and without litigation.
